Can You Avoid a DUI Conviction in Alberta? Top Legal Tactics Revealed | Kolinsky Law
Facing a DUI Charge in Edmonton can be overwhelming, with serious consequences like license suspension, hefty fines, and even jail time. But here’s the good news—a skilled DUI Lawyer in Edmonton can help you fight the charges and protect your future. At Kolinsky Law, our experienced Impaired Driving Lawyers in Edmonton have successfully defended countless clients using proven legal strategies. In this guide, we’ll break down the top defence strategies for beating a DUI charge in Alberta, so you know what to expect—and when to take action. Why You Need a DUI Lawyer in Edmonton A DUI conviction in Alberta can impact your job, driving privileges, and even your ability to travel. Before you accept a guilty plea, consider these key defence strategies that could help you avoid a conviction or reduce penalties. 1. Challenging the Traffic Stop Police must have reasonable suspicion to pull you over. If they lacked a valid reason (e.g., no erratic driving or traffic violation), your DUI Lawyer in Edmonton could argue that the stop was unlawful, potentially getting the case dismissed. 2. Questioning Breathalyser & Blood Test Accuracy Breathalyser devices must be properly calibrated and administered. Common defences include: • Improper calibration or maintenance of the device • No proper observation period before testing • Medical conditions (e.g., acid reflux, diabetes) affecting results If the testing was flawed, your Impaired Driving Lawyer in Edmonton could challenge the evidence. 3. Proving Charter Rights Violations Under the Canadian Charter of Rights and Freedoms, you have the right to: • Legal counsel upon arrest • Protection against unlawful detention • Timely disclosure of evidence If police failed to inform you of these rights, your DUI Charge in Edmonton could be thrown out. 4. Raising Doubts About "Care and Control" Even if you weren’t driving, you could be charged if police believe you had "care and control" of the vehicle. However, a strong defence could argue: • You had no intention to drive (e.g., sleeping in the car) • You were not in the driver’s seat • The keys were not accessible 5. Negotiating a Plea Bargain or Reduced Charge If the evidence is strong, your DUI Lawyer in Edmonton may negotiate for a lesser charge (e.g., careless driving) to avoid a criminal record. What Are the Penalties for a DUI in Alberta? A DUI conviction can lead to: • License suspension (1 year for first offence) • Fines ($1,000+) • Mandatory ignition interlock program • Possible jail time (for repeat offences) For a full breakdown, read our guide: Understanding DUI Penalties in Alberta: What You Need to Know Can You Get Your License Back After a DUI in Alberta? 7 Year old Gelding
Red - Gelding 7 year old Arab X Red is an in your pocket kind of guy, easy to catch, tie, good for farrier. Has been roped around and off (lightly). Lives inside or out. Around kids and dogs, has lived in a private pen and with another gelding here. Lead behind side by side and quads. Someone put a decent start on him at one time because he has a few buttons, just needs consistency. Happily walk, trot, canters over poles. Good around cows. Just needs more miles than I can give him at this point in my life as he wasn’t supposed to be quite this much of a project. I’ve had him since May, bought to be a horse for my husband and eventually kids but I can’t see that in his near future therefore he is for sale. Forward ride, needs a soft hand. Happiest to go on a lose rein at Red’s speed so if his quirks can be sorted, he will be a cool guy. The quirks: Does not like spray bottles, but if you have the time this can be dealt with as he is very smart. Some days he decides to spook at the same brush I’ve used everyday. He can be buddy sour but does work out of it, which is why I have him in a private pen and haven’t had issues. Randomly will decide to not load, I haul him a ton. Needs work on soft, supple and collected. Respectful of his humans, so even when he’s having a moment will stay out of your space. Teeth, vaccines (4 way & 3 way), deworming up to date as of June 2024. Trimmed every 7 weeks. Located SW of Stony Plain

**URGENT: Family Desperately Seeking Acreage
**URGENT: Family Desperately Seeking Acreage to Rent by End of Month** Hello kind community, We are reaching out today with heavy hearts and an urgent plea for help. Due to unforeseen circumstances, the acreage we were supposed to move to has fallen through, leaving us in a dire situation. We now have until the end of the month to find a new home, and we are truly desperate. We are a family of four and a host of beloved animals, including our livestock and dogs. Our animals are not just pets; they are an integral part of our lives and losing them would be heartbreaking. We are searching for an acreage to rent in Sturgeon County or Parkland County, but at this moment we are open to any location that can accommodate us. We understand that finding such a property on short notice is a challenge, and we are more than willing to put in the effort to make it work. Whether the property needs maintenance, repairs, or even extensive work, we are prepared to roll up our sleeves and get to it. Our family is committed to taking care of the land and making it our home. If you or anyone you know has an acreage available or knows of someone who does, we beg you to reach out to us. Time is running out, and we are in desperate need of a miracle. Please help us keep our family and animals together by providing a lead or an opportunity. Thank you for taking the time to read our plea. Any assistance or advice you can offer would mean the world to us. With deepest gratitude and hope, Bill and Cassie

Our Puppies are ready for THEIR next adventure! Mom (Penelope) is a Masked Lilac Fawn and Dad (Shazam) is a New Shade Isabella Tan All our puppies are hand-raised and underfoot in our LARGE family! We know our pups and ask the questions to ensure that a Frenchie is the best breed for you. Please read the personality of each pup, and ask about the one that you think would be best for your family. Kia (MALE, GREEN COLLAR, Red Lilac Fawn, $2500) - This little man tugs all the strings! His facial expressions are one, SMILE. Kia is always smiling. He loves to love and will expect this in return.
