But here’s the good news—a skilled DUI Lawyer in Edmonton can help you fight the charges and protect your future.
At Kolinsky Law, our experienced Impaired Driving Lawyers in Edmonton have successfully defended countless clients using proven legal strategies. In this guide, we’ll break down the top defence strategies for beating a DUI charge in Alberta, so you know what to expect—and when to take action.
Why You Need a DUI Lawyer in Edmonton
A DUI conviction in Alberta can impact your job, driving privileges, and even your ability to travel. Before you accept a guilty plea, consider these key defence strategies that could help you avoid a conviction or reduce penalties.
1. Challenging the Traffic Stop
Police must have reasonable suspicion to pull you over. If they lacked a valid reason (e.g., no erratic driving or traffic violation), your DUI Lawyer in Edmonton could argue that the stop was unlawful, potentially getting the case dismissed.
2. Questioning Breathalyser & Blood Test Accuracy
Breathalyser devices must be properly calibrated and administered. Common defences include:
• Improper calibration or maintenance of the device
• No proper observation period before testing
• Medical conditions (e.g., acid reflux, diabetes) affecting results
If the testing was flawed, your Impaired Driving Lawyer in Edmonton could challenge the evidence.
3. Proving Charter Rights Violations
Under the Canadian Charter of Rights and Freedoms, you have the right to:
• Legal counsel upon arrest
• Protection against unlawful detention
• Timely disclosure of evidence
If police failed to inform you of these rights, your DUI Charge in Edmonton could be thrown out.
4. Raising Doubts About "Care and Control"
Even if you weren’t driving, you could be charged if police believe you had "care and control" of the vehicle. However, a strong defence could argue:
• You had no intention to drive (e.g., sleeping in the car)
• You were not in the driver’s seat
• The keys were not accessible
5. Negotiating a Plea Bargain or Reduced Charge
If the evidence is strong, your DUI Lawyer in Edmonton may negotiate for a lesser charge (e.g., careless driving) to avoid a criminal record.
What Are the Penalties for a DUI in Alberta?
A DUI conviction can lead to:
• License suspension (1 year for first offence)
• Fines ($1,000+)
• Mandatory ignition interlock program
• Possible jail time (for repeat offences)
